This company made an oral agreement for settlement on amount owed, with me and now because it changed case workers they have increased it by $1100.00. Also, we have sent letter after letter not to call us to do everything via email or via mail. We cant seem to get any response. They continue to call and say they never received anything about not calling. They just don't care...

hi--

OK, first, the problem with ever dealing over the phone is what you have just encountered. CA's have a system that allows them to put notes on an account, so they can internally document what happens when they call you. I have no doubt that if there was a real settlement offer agreed upon, that it would be in those notes. However, it is a common tactic that youre seeing now--a lot of times they will agree over the phone like this because anything they can do to get you to send money will be done.

As for the phone calls, how did you send them this request? Your best bet is to send any letters you need to send by certified mail, return receipt requested. You see, it is illegal for them to continue calling you after you tell them to stop, but if you sent the letter by regular mail, then you have no proof it was sent or received.
