does the dealer have to allow you to remove your personal items from the car if it has been repoded. The car was wrecked and the dealer was not notified. He found out when the car was repossed. Now he says that I cannot get my personal belongings out of the car until I pay to have the car repaired.


Legally, you did not sign a security agreement for "personal/tangible items" outside of the vehicle itself; therefore the lienholder has no security interest in those items and cannot hold them as collateral.

When you talk to them next, ask them if they filed a UCC on those items at the inception of the loan. If a UCC was not filed and perfected with the Secretary of State, they cannot hold the items.

Make them aware that you know your rights and they cannot hold personal effects. If they refuse to give the property back, file a complaint with the state AG office.
