Cash Direct Express outcome

Well, they sent me PIF contract to sign and wanted me to withdraw any complaints or at least update the bureaus with which I've filed complaints that we've reached an amicable decision.

Here is what they sent me today!

Dear xxxxx,



I am writing in reference to your correspondence received on June 6, 2007.



Please be advised that Cash Direct Express is as follows:



1. Cash Direct Express is a lender licensed under the laws of Delaware
2. Cash Direct Express is not conducting business in the State of Wisconsin

3. Cash Direct Express does not maintain a location in the Sate of Wisconsin


As was specifically stated in your loan agreement, the loan was provided in accordance with the Laws that govern licensed lenders in the Sate of Delaware. Our physical location is in the State of Delaware . The loan was approved and funded in the State of Delaware .



In addition, I’d also like to mention that Cash Direct Express has modeled our short term loan product to disclose all information available. We believe in being proactive for our customers and providing all pertinent information prior to funding. This step occurs when our customer’s are presented with their loan agreement. This allows the consumer to conveniently view the structure of our product and make sure that they are satisfied with the service we provide and with all provisions set within the agreement. By signing this agreement Cash Direct Express believes the consumer has taken the opportunity to thoroughly review the agreement and would like an opportunity to utilize our service. With careful review of the correspondence received, your account and its notations it appears that you have used our services once prior to your current loan. I’d also like to mention that our agreement and the provisions set within the agreement have not altered during your relationship with Cash Direct Express.



Although we fundamentally disagree with the allegations in your emails and are confident that we have been, and continue to be, in compliance with all applicable laws, we would still prefer to resolve this mater amicably. Although we have no legal obligation to do so, we are willing to consider any misunderstandings you may have had when you obtained the loan and are proposing a reasonable resolution.



In an effort to resolve this matter, we are willing to release you from the outstanding balance of your loan $207.00 as well as any uncollected fees owed to us. We will do so upon receipt of the signed Confidential Mutual Release Agreement (see attached) and receipt of evidence that you have withdrawn any and all complaints you may have already filed. Please fax the signed attached document to our Customer Relations Department at (866) 432-2736.


I don't get a refund, but now I can fax this to their collection agency as well. Yay!

I have to call Geneva Roth...they left me a vm today after a week of sending my email, so I am nervous.


Congratulations! :D That is awesome news, you must be feeling better. :D :D :D Don't be nervous about Geneva Roth, they are just a faceless stranger on the other end of the phone, and they can't reach through the telephone lines and grab money from you. (At least I hope not, not unless you are having dreams with Freddie Kruger in them :shock: )

So I faxed the mutual release agreement back to Ms. Callaway at Cash Direct Express...surprisingly, she is very cooperative and friendly to work with, and it almost made me feel back I was paying the $230 back to them...ALMOST! Anyway, she is sending me the PIF letter and already contacted the CA that my defaulted loan was handed over to, so they are aware of the updated situation. However, Ms. Callaway said if I have any problems with them I can always give them her number as a reference. But I may still fax over my pif to them, just to cover my bases.

Geneva Roth's call was bust today...they were just calling to say they need money since my loan defaulted, and the lady handling collections hadn't received my email yet...so no new updates. :( I just have to wait some more.

That is good news for you. And that is great. I've never dealt with Geneva, I have read other's experiences with them, you may be in for a battle. Just google their name and you will find what others have said about their experiences. Just stand your ground with them and you will be successful.
