Received summons from FIA

I just received a summons from FIA Card Services and until I did some research online did not know they were associated with Bank of America. The summons states that I owe $2800 from 2002 when the cards were issued. I made arrangements with Bank of America to pay off the cards with monthly payments, which I did for a number of years bringing my balance down from $10,000 down to $2800. A representative from Bank of American would call me every month and would I would authorize payment through my non-Bank of American checking account. I would also get monthly statements letting me know what the balance was on the account. The statements stopped as did the phone calls for some reason. Now I get a summons from FIA Card Services who I have no idea who they are and are not the company that I opened my credit card account with saying they are suing me for the balance due. The summons is very vague as it does not say much of anything other than "see exhibit A" attached but "exhibit A" is NOT attached on my summons. Also, the account was opened while I was in Florida but now I am in South Carolina.

Does the SOL come into play here and does FIA Card Services have to prove that I still owe the money and that they are the ones who I owe the debt to?

I would appreciate any help in this matter in how I should go about this.

I agree also -- the statue comes over where the card was opened -- you should contact them and get everything in writing that you agree to -- also check online for the court status -- your county should have it available if it is online

Your SOL would be based on the date of your first deliquency.....any idea when that was??

It is not the banks responsiblity to call you every month for your payment....that is your job. When the calls stopped coming, you should have been the one to call them.

FIA Card Services is a subsidiary of BofA. They basically process credit cards on the behalf of BofA. The SOL period on the debt will be applicable of the state where the account was opened. In your case, the account was opened in Florida. So, the SOL period of that state will be applicable.

Give a reply to the summons as possible.
