Old credit card debt
Date: Mon, 04/30/2012 - 09:40
I do not remember all of the details of this matter but a collection agency called me and said they were making a recommendation to a legal firm to pursue. I was told it had gone to different collection agencies as they buy each others accounts and even to a legal firm. They said I had a credit card that opened in 1999. The last payment was in 2004. They are now threatening to sue me for over $2800. In 1999 I was mostly out of work because of an on the job injury and follow-up back surgery. My credit score was sub - 400. There is no way that any credit company would have extended me that much credit. I had (2) "starter" cards with $250 - 300 credit but that is a far cry from $2800. If Tennessee has a SOL of 6 years, what do I have on my side and what should I expect, in your opinion?

Hi robbow1,
I agree with Soaplady. You should do what she has said as no one can sue for a debt after the SOL period. So, you should tell them that they should threaten you and you're aware of the laws, and if required, you can lodge complaint with FTC that they're harassing you.

Let me just make one correction. You CAN be sued but, as long as you use the defense that the debt is time barred, you cannot lose the suit.
