Last week I was contacted by McCarthy, Burgess & Wolff and was offered a settlement of $1200.00 over 3 months, but I had to take it immediately. I told them I would consider but couldn't give an answer at that time because I was concerned about why the original payments weren't adhered to and needed to contact Staples. MBW got very ugly and hung up on me.
I immediately contacted Staples and explained the issue. They instructed me to fax in a dispute letter to them, which I did, and they said it would take about 30 days to investigate. The next day, received call from MBW and I explained that I was working with Staples. Again, man very ugly and said he would note that I was unwilling to cooperate.
Since that time, MBW calls me daily. I am waiting on investigative response from Staples and I also sent settlement offer to Staples with exact offer that MBW offered, but payable directly to Staples. Am I still get a daily call from MBW.
Can anyone offer recommendations? I have yet to receive any written correspondence from Staples or MBW that indicates that my account has been transferred. Should I initiate a DV to MBW? Or since I'm attempting to deal directly with the OC, should I send a request letter to stop contact? I've tried to explain and I'm willing to work on a settlement, but MBW is really the ones that are unwilling to cooperate. And Staples has said that they would get back with me.

MBW has 5 days from initial contact to send you a dunning letter advising you of your right to dispute the debt. I would send them a DV ASAP, it should keep them off your back until Staples completes their investigation.
It makes me laugh every time I hear a collector say they will note the account as refusal to pay.

Issue Resolved
Just wanted to provide my experience to close this issue out. Hopefully others will benefit. I was able to settle for 45%, payable over 45 days. I sent a letter to MBW & Citibank with my settlement offer which generated a phone call from MBW to accept. I received a written settlement letter stating that once the payments were made, the account would be considered settled in full. Payments were made to Citibank. I've since completed payments and received confirmation letter that all payment have been received and awaiting the 10 day period for the check to clear before I get one more letter to confirm all complete. This should be arriving this week. Thanks for all the help!
