statute of limitations-Texas
Date: Wed, 07/28/2010 - 17:03
Nelly,
How do I determine the statute of limitations for a credit card that I have? I fell behind back in 2004, and tried to make payments through a company called PARAGON WAY. But, they never would mail me proof of my original balance or anything showing my payments. Am I still liable for this balance?
Thank you,
Elizabeth

Liz, you are ALWAYS liable for the balance. They just can't sue
Liz, you are ALWAYS liable for the balance. They just can't sue you after the statute, and it falls off of credit after 7yrs. TX is a very debtor friendly state. The statute in TX is 4yrs from date of last activity. The date of last activity is when you made your last payment on the account. Hope this helps.
