Hello All,

My spouse has run up a huge amount of unsecured debt, and we're seriously considering a debt settlement agency, but I'm apprehensive from a couple of perspectives

What is my legal responsibility regarding debt that she has established on her own without my signature?

In the event that debt settlement does not work, is it possible to file chapter 13 individually if you are married?

I'm basically trying to protect at least one of us, and I'm in good standing with all of my debts including the mortgage, etc.

You are not bound to be related in any way with a debt with your spouse as it is not a joint debt and your signature is not there on the deed.

Only one spouse among a married couple can file Chapter 13 Bankruptcy if and only if the debt is not a joint one.
