Hi. I live in FL. Have atleast 9 payday loans. I've read some posts but still not sure how to start with getting these companies off my back. I know I've grossly overpaid and by doing some research I think most of the companies are practicing illegally according to my state's statues on the subject. I need assistance in what to do after I close my account. I would also like to know if I can get in legal trouble with the bank for having NSF.

Send copies of ACH Revocation to bank and lender

Close down bank account and open a new one

Contact illegal lenders, tell them that you know they are illegal and you are only liable to pay off the principal amount

Offer to pay over easy extended period/demand a refund if you have overpaid

File complaints with the AG and the FTC

Think of payday loans as the Ebola virus and stay away from them if you want to live.

No, banks won't give you any trouble over NSF. As long as there is no overdraft, they will play along with you. Talk to the manager directly if you meet a snag while trying to close your account.

:mad::mad:I went to Bank of America, to see if there was anything I could do because the lenders hit and I was then overdrawn. They had me going in circles for about an hour from the fraud dept. to customer service. End result, my acct. is still open. It cannot be closed while overdrawn. Also, I was told by the Fraud dept. that since I gave them my bank acct. number, then it isn't fraud. Not sure where to go with the bank. I emailed the lenders with a revocation letter and I am in the process of filing claims with the AG's office and the FTC. Not sure what else to do. It's assinine to think the bank would knowingly keep the acct. open after what I've disclosed to them. They also claimed that they need a Paid In Full letter to close the account and for me to open a new one. I'll take any additional advice you can give.

Keep going up the chain at the bank.

1. They're required to follow your ACH revocation. They didn't. Those overdraft fees are their fault.

2. It IS fraud because you authorized them to withdraw the funds to repay the loan. Your loan has been repaid, right? So, if they keep withdrawing, that's unauthorized!

:) I just wanted to say thank God and the creator of this site. I am still going through it with the payday loan companies, but I do see some light at the end of the tunnel. So far, no one responded to my revocation letters, but I filed claims with the BBB and in a matter of two weeks, Spot On Loans sent me a letter that my loan was paid in full and Plain Green Loans said they settled the matter and my account was up to date. Thanks to the BBB. I am still fighting with CashCall and Eastside lenders. I will keep you posted on that. If it wasn't for this site I would have gone with the debt consolidators who told me it would take about two years to clear this up. It's not easy and between the phone calls every five minutes and the emails it's frustrating. I just wanted to tell others with this issue that if these pdl's are illegal or not licensed in your state you have a leg to stand on. File your claims with the FTC, BBB, and the AG. Now I have debt collectors that the pdls have sold my acct. to, to deal with. Like I said it's not easy, but it's the cheapest way to go and it is a definite lesson learned to stay far away from these predators. By the way. Bank of America was no help, they were not customer friendly until I called one day and happened to find someone who could reverse the fees, but only if I paid what I owed then they would close my acct. When I close it, they can forget it! it's closed for good.

This is a bit hard for me to wrap my head around, but I would be inclined to not stir up any trouble with the bank as far as the source of the debt. I would say just do what you can to make payment arrangements with the bank.
