Advice please

I contacted a company to try and do a debt managment program-and they ended up taking money out of my account each month- and not paying or contacting anyone! I was able to get a portion of my money back from this company. I eventually contacted another company and entered a dmp, all of my credit card companies were willing to accept but 2 of them. In the meantime, I have received notice that these 2 companies sent me to collections. The first collections company, I made a payment to- asked them to send me something in writing showing that I have am paying them directly- have not received anything after 2 weeks-.The other one that was sent to collections, a payment plan was set up with the original c.c. company- I sent them a letter letting them know this, and that is where I stand right now. I am not sure what to do - so scared I am going to get sued-wages garnished or a frozen bank account- should I be contacting a lawyer? It has always been my intention to pay what I owe- But after being robbed by the first DMP, I cant even afford the past due amounts.

To have your wages garnished a CC company would have to sue you first and you would be notified, thus you would have sometime to call them and try and work something out. If you did go to court and they got a judgment then they could possibly garnish your wages but this also depends on your state as some states don't allow this. They also can't freeze your acct. etc.

On your first card this is in collections that you made a payment to - don't ever make a payment until you have something in writing from the company, since you have already made a payment I would get proof ready and have this handy, get it from your bank if that's how you paid. Also - if you did give them your checking acct number, you need to watch this account very closely as some unsavory collectors try and pull money from your account. Once you have proof you paid, I would call the collections agent again and request your receipt. If they refuse I would write them a letter enclosing a copy of your proof. Do not make any other payments to this account until they provide you with a payment plan or something you can agree to in writing and this includes the payment you already made.

As to your second account - if you were able to work something out directly with the CC company for the debt sent to collections, your letter should be sufficient, but keep proof of your payments to the original CC and make sure you check your credit report in a few months to ensure this other CA isn't reporting this debt, you don't want it showing up twice on your credit report.
