Okay, so I recv'd paperwork to answer a summons and I have 30 days to do so. I called HSBC to ask who the account was sold to and the date and they advised it was sold to CACH LLC on 7/2008 which matches what is on the summons. And yes, it's true that I did have a card with HSBC and recall last time paying back in '07 but I was going to fight this case just so I can hopefully find some type of loophole but it doesn't look good. I was told to answer the summons to cover my butt but that I should also negotiate a payment plan or maybe a payoff. I have very little money so I'm not sure what to do and need advice. THANKS!


Yeah, negotiating an outside the court settlement is possible to avoid going to the court. You may call up the lawyer of the plaintiff to try out a settlement.

Gizzle, whoever have told you to reply to the summons, is absolutely right. Don't forget to file your reply even if you consider settling outside the court.
