So I just got sued...advice?
Date: Wed, 01/30/2008 - 17:00
I just got served with court summons for a somewhat old debt. The original creditor was Discover, but they sold the debt to Calvary Investments. The SOL is 5 years - the summons says that the last payment was made in February of 2003. I don't recall making said payment, and would have been out of a job then so I'm not sure how I could have made one, but whatever.
SO! My question to you, dear forum people, is what do I do now? I'd be willing to do a payment plan, I guess. The debt is from when I was young and stupid and I'm slightly less young and slightly less stupid now. I'm guessing they won't go for that?
I thought about one of the debt consolidation places, but I don't even know where to start. I don't have a house or a car, but if they try to garnish my wages - I just don't want my boss to know, you know?
I'm sort of in shock, really, but any advice would be great. I feel like I'm going to puke. I just have no idea what to do.

The first thing that you will want to do is to answer the summons, if you don't they will win by default and you don't want that to happen.
Secondly, they may take a payment arrangement, give them a call they may work something out with you, it costs them money to go to court too.
goodluck and keep us update. If you have questions on how to answer the summons come on back, some one here will help you out.
What do you mean by answering the summons? It just tells me to
What do you mean by answering the summons? It just tells me to go to court towards the end of next month. I'd like to get it taken care of before then, if I can.
Thanks for your reply!

If you are able pay, offer them half. If not you will have to arrange payments. This company bought the debt from discover for next to nothing, so they will take anything they can get.

There's no way I can do half.
What's weird is it says the debt was charged off in November of 2002, but then says I made a payment in February of 2003. I didn't even realize you could make payments after it was charged off.
I'm hesitant to call them because I don't want to get myself in *more* trouble. Blah.
