is my wife liable for my bad debt?

I received a summons from Suttell & Hammer for debt I owe Citibank.It states that a lawsuit has been started against me. I don't have a job right now but my wife does. Can they garnish my wife's wages instead? I am from wa.

Wage garnishment is an order of a court for an employer to withhold a certain amount of your wages as repayment for debt and it doesn' t include voluntary wage garnishment.

As far as my knowledge is concerned, garnishment of wages takes place only after a lawsuit has been filed and won. Is your wife anyway related to the debt?

The creditor or collector can garnish the wages, if they receive a judgment from the court. If your wife' s name was not listed, then you need not worry so much.
Along with that, until and unless your wife' s name is not on the judgment, she won' t be considered a part of the debt.

Moreover, if the debtor doesn' t turn up after being summoned, then the question of default judgment will arise and it might lead to garnishment.
