dismissed with prejudice yet collecting again

Ok backstory, in 2006 my juniper credit card was charged off. In 2007, Harvest Credit Management bought the account and used underhanded tactics to try and collect. They sued me and I countersued. In return for dropping my claim, they dropped their claim and it was dismissed with prejudice.

Fast forward to this week. I get a letter in the mail from RPM collecting on behalf of Harvest for that same account. Wouldn't that be a violation since the case was dismissed with prejudice 3 years ago?


I have a call into the lawyer who represented me back then. It's still within the SOL but I thought one of the terms of the dismissal was that Harvest would not sell the debt to anyone else and would not try and collect again (in other words, for me dropping my countersuit for FDCPA violations, they pretty much would give up on the debt)

So what's the latest? I got a DWP vs AmEx in Oct 2009. Still trying to get my record clear. I finally found the decision. Last week I mailed a certified copy to Experian. Soon I'll hit Equifax and TransUnion. I sent an uncertified copy to First Source Advantage, the presumed debt buyer. So hopefully I can get them to play ball and get them off my case forever. This is a nightmare!!!
