Being sued by Apothaker and associates for Discover from 2008. Have not provided debt verification because was not requested within 30 days of initial letter. They say they are acting on behalf of Discover and the account is still owned by Discover and are unable to negotiate what is owed. Is this how this usually works?

I think Discover has assigned the account to the collection agency as you have defaulted on it (considering you really have an account with Discover). If you are not being able to negotiate a settlement with Apothaker, then you can contact Discover regarding this issue. You can tell them that you want to settle the debts with them. If they agree, then settle the debts after singing a written agreement. If they are not interested, then you've to settle the debts with the CA. You can get help of a debt settlement company regarding this matter. However, before proceeding in this matter, check whether or not you really owe the debt. Also check the SOL period of the debt in your state.

Finally, if all your efforts go in vain, then consult an experienced attorney in you state. The attorney will help you handle the case in the right way. The attorney can also help you to draft a proper reply to the summons. Don't forget to check whether a case has really been filed against you.
