Is it possible to get a settlement from Capital One even after a judgment in their favor has been issued. I would really like to deal directly with Capital One because the law office they have on my case is going to end up making me file for bankruptcy. I was paying them $100 a month (via bf) and was one day late with a payment so they decided to garnish my bank account because I am not employed and wound up getting my last $30. I would like to pay Capital One off but cannot risk dealing with issues like that that further stress me out so I would like to know if it is possible for me to propose a settlement and if so how do you suggest I go about it? I currently owe them about $4,000.


I personally don't know anyone who settled with Cap One. They are very aggressive. I tried settling to no avail. They allowed me to bring the account up to date over 2 payments and now I pay the monthly charge. However, I only owe them about $900 so I'm not so concerned. This was my last settlement and I caved in. You can do a search on the site for Capital One and read about Cap One with others.

I settled two cards with Cap One. They can be difficult. One of the accounts was actually my first settlement and funny enough, the other account was the last settlement. That last one was really tough. Some of my other settlements were starting to hit my credit report so they knew that I probably wasn't going to file bankruptcy at that point. But at the end of a month, their collection agency (where it was sent after charge off) finally settled with a number I could accept. Wasn't a great settlement but it was done.

since you have a judgement already you will just have to try to see if they will settle. As far as they are concerned, they have a judgement that will allow them to take years to collect the full amount - unless they feel you can and will file bk. That is what you need to make them think, Do a consultation with a bk attorney so that you will have a name and number to give the cap one people. Maybe this will jolt them to do a settlement.
