Wages cannot be garnished in texas for civil judgment private student loans. Only federal student loans can garnish, and they do not need a court order.

IThe loan is not on the National Data base with my other federal loans so I am thinking it is private. I even had to have a co-signer. I had my income tax garnished on my actual federal loans, until I did a consolidation on them, but it did not include the private loan. It was an Old Bank One Education One loan that I think was backed by TERI, but it has never shown up on the federal student loan data base and I was told that all federal loans show up on the national student loan database. The private education loan I got required a co-signer. I thought if my loan was federal it would show up with the Fed's but they have no record of it at all and are only consolidating the one's they call federal. So, how would I know if it is private or federal if the DOE already listed the federally backed loan? Is a non-profit backed loan considered private?

So, basically what your saying is that although the debt collection agency is sueing me for a TERI backed student loan on behalf of the National Collegiate Trust, they can't garnish my wages in Texas after the award but they can get any future bank accounts for ten years? I am really trying to ease my mind because as a special education teacher I have to pay the federal government what I owe them as well as the teacher state preparation program that trained me. Any extra outcome will wipe me out literally in the first month. Are you pretty certain that a TERI backed loan assigned to a debt agency in Texas can't garnish my wages? Should I appear in court even though I can't afford an attorney? don't know if the SOL will work for this co-signer loan but as long as they can't garnish me in Texas while I am paying the Fed's I would feel a lot better. Please help me understand because I have no knowledge on student loans backed by TERI. If they are awarded a judgement then don't they give up their rights to pursue me after ten years? Once, your sued can you be sued twice?
