My ex-husband had a Wells Fargo line of credit, applied for over the phone. ?He was hard of hearing so with his permissioin I gve all the information. His Tax Id and info. He recently filed Chap 7 bkrtcy. The account was chgd-off 8/2009. I recently received letter from local attorney demanding payment.l understand California was governing law. I live and made application in texas. What is SOL on this debt. Appears ex quit making payments in 2/2009. I have never had demand letter or any correspondence. They claim I am guarantor. they doint have record of my SS # but place as chg-off on my credit bureau. Need to know SOL in this situation. thank You

First of all, you have made a great mistake by revealing all the information via phone. The Sol period in Texas is 4 years. It will start from the date of first default. Has your husband included this debt in bankruptcy? Usually, automatic stay is issued by the court after filing bankruptcy. Henceforth, the creditors can't take any action against your husband.

The issue here is not the husband...it is the wife as a guarantor. Plus applications for lines of credit with a bank like Wells Fargo who you already have a relationship with is common.

Statistics show that most husbands and wives bank at the same bank. Thus the bank would have her social security number. They may have had a joint account. However a line of credit account would be a separate account. If this was a secured line of credit based off a joint Wells Fargo Mortgage, then she automatically would have been put on the account.
