My income is fixed/salary, albeit nearly 4k/mo. I already work nearly 60 hours/week so I can't make any extra, I have over 57k mostly in credit cards. Over the last 2 months I got into payday loan hell thinking I'd be able to get out of it quick, I still have 3 to pay off.

I've tried to make a budget, I literally don't spend ANYTHING, got rid of my cable, internet, next to go is cell phone. I'm eating ramen and have sold everything I can. I have NO furniture, other than I bed I rented from rent-a-center because that was all I could afford. I owe a friend $1700 I borrowed before taking this new job and moving 1500 miles across country. I earned nearly all my debt on grad school, I won't even mention the 80k in student loans I've wracked up.

I used to be ahead, had good credit, money left over, etc. The last 3 months I thought I would get ahead, it's so frustrating, I'm treading water just to keep my credit cards from getting too far behind, some are past 60 days now.

I've been reading everything I can on this forum. I considered BK but because of my income I wouldn't likely qualify for chp 7, and to me filing so you can work out a payment plan seems useless?

I don't have enough to make a settlement, I have no savings, no retirement.

I'm current on a car loan that will be paid in about a year, at 380/mo.

Here's my spreadsheet, if anyone has any other ideas of how I can dig myself out of this hole, I'd appreciate it.

as you can see, it doesn't quite balance out!
i've organized by budget by each payday, the other horrendous
thing is each payday I end up with overdraft charges because I have
nothing left, I'm trying to be more careful but the payday loans have
totally screwed me

Not paying them is not an option, as I could lose my job.

I work in a high profile profession, having my job called is NOT an option,
I already changed my phone number because I was getting fraud calls.

I really could use some brainstorming about some options.

The only other thing I can think of is trying to negotiate out of my lease
and living somewhere else for cheaper, I also tried to get a roommate
and got no offers except a scam.

I may explore that route further as it would give me about 500/month.
I tried advertising on craigslist, but twice received NO response.

You have done a mistake by taking out pdls. They are a curse. Find out whether or not the pdls are legal in your state. If they aren't legal, then pay back the principal amount only.

You can definitely try to work out a payment plan with your creditors. Explain your situation to them. They may agree to work out a payment plan with you. Don't lose hope.

Try to get a job with better pay scale mate. Talk to a credit counselor if possible.

What state are you in??? Are you loans even legal? If they are not legal, you only owe principal.

Peppercash is ILLEGAL...offshore in Costa Rica.

RAC...you paying $100 per month for a bed??? That is $1200 per year for a bed that is probably worth about $200 Try craigs list or freecycle for beds and mattresses....freecycle you can probably get the frame and headboard for free, even look at the free section on Craigslist.

What is the status of your student loans???

Okay, listen, I'd love to sugarcoat this for you, but the reality is that you're in a pretty bad financial position. And the reason for this is that you simply can't seem to catch up - probably from the Payday loans.

Sorry, but you're going to have to take some action soon. I know you said that you were hesitant to file Chapter 13, but it sounds to me like your only options are Chapter 13 or debt settlement. As you said, you probably won't quality for Chapter 7, and I don't believe the payment arrangements you'll get through a consumer credit counseling agency are going to do enough to help ease your cash flow problem.

If you consult with a bankruptcy attorney, I'm sure they can give you an estimate of what your new monthly payments will be, and if it's not enough to help you out, you may want to consider debt settlement.

Problem is, with debt settlement your accounts will go further delinquent than they already are, meaning that your credit score will be further reduced - at least temporarily. If you choose this route you can probably be out of debt within three years. But, you're going to have to be extremely disciplined.

Wishing you the best of luck!

Marie is right.

The simple answer is you've been living way beyond your means for quite some time.

Whether you choose to file for bankruptcy or settle the debts on your own (which we can try to help you with), I think you're going to need some serious financial advice.

You need to learn to budget, learn the difference between necessities and other things. I've been there. I'm not preaching. It took me a LONG time to figure things out.

Getting rid of the PDLs is your first step. Peppercash and PDLYes are illegal. CashNetUSA is usually legal. I couldn't tell from your spreadsheet if you've paid them off or not?

You're going to have to follow the advice in this forum for getting rid of the illegal PDLs. It's the only way to protect yourself. Just be upfront with your employer about the lenders being unlicensed.

I appreciate the info. I completely agree that I've been living beyond my means. I was thinking back to before I had 57k in credit cards and I literally didn't pay for hardly anything in cash. I had a housekeeper, private exercise training, etc, etc. This has just been a complete shock to me. I was unemployed from June 2010 to Dec 2010, and never changed my lifestyle! I was then also unemployed from Feb 2011 to June. I don't even have a good reason. RIDICULOUS!

Believe me, I'm not looking to blame ANYONE but myself, I just wish I had seen the light sooner.

I can't change my profession for higher pay, I spent 30k on grad school to be where I'm at. Believe me, it's the one good thing I have going for me!

My spread sheet didn't post right, sorry, it doesn't make much sense.

When I added up the numbers it's not too bad with cashnet, regarding what I've paid and what I've borrowed.

the other two are RIDICULOUS, the peppercash this time didn't clear, I'm wondering if they will try to hit my account again? They didn't last time it didn't clear.

I called chase today, I have 3 accounts with them, totally about $800 past due, she agreed to take a $219 payment to bring one account current, it's close to 90 days past. The other two, I discussed a hardship program, that would reduce my interest to 6% for 5 years, with payments of $74 and $87, I added up and it's a pretty good deal.

I dont know what im going to do about the other accounts.

I suppose it wouldn't hurt to talk to a BK attorney. How long does a payment program with chp 13 usually last?

Student loans are in forbearance, (they've been deferred x2 years from attending school) all federal. I've made payments on them off and on but not in a while. Never been late.

I had a credit score of about 750 before June.

I've paid for the bed from RAC. I'm returning the couch I got 2 wks ago. One reason I went with them is I have no way of moving a bed by myself, I sat on a lawn chair in my living room nearly 3 months, but now I don't even have cable, so it doesn't matter.

I have a friend that works in accounting and I've given her all my info and she's helping me try to work on a budget.

I've starting clipping coupons, I don't spend hardly anything except bare necessities.

I live in North Carolina, btw.

One thing I thought of was rehabbing my car loan? I guess I don't know how that works, do you have to have a good credit score? It's worth about what's left on it, maybe $4000.

The only thing that irritates me and granted it's completely my own fault, but is how i got extended nearly 57k worth of credit for me to max out. Just because I had a good income and a good payment history.

I'm also an idiot for not looking at my budget closer and renting a townhome that is too big for me anyway when I could have gotten something cheaper.

It's frustrating because I got myself into pretty big debt before I graduated with my bachelors, I made good money when I graduated and paid nearly everything off, 3 private student loans, didn't have many credit cards, paid one car loan off early and got this car. Had over 1K in my bank account at any given time and ever built up a 401k and savings account. Now I'm terrified something will happen and I don't have a dime to pay for it.

I still havent gotten new car tags that were due July 31.

So frustrating!

Again, I want to thank you all for great advice!!

I don't mind the reality checks, I clearly need it!
