daughter's X husband Not following Court Orders

My daughter has been harassed now for several years due to being co-signer for a student loan and allowing her then husband to use her credit card for his degree while they were married. She later divorced him as he was dysfunctional and only wanted her to be his mother and take care of him, he quit his job etc… a lazy person… anyway…
She got a court order from the divorce (at State District Court) stating that she was NOT responsible to pay for the student loan, OR the credit card Or the home…
This order was re-enforced by a commissioner’s signature 2 years later (last month)..
MRS associates are harassing her as well as the credit card people… the home is gone into foreclosure… her credit ratings have dropped all due to her dysfunctional X husband NOT obeying the court order…of the divorce.
MRS will not allow her to talk on the phone to explain,… so I am sending them a certified demand letter…I know how to do that, as I have litigated against government companies for violating sovereign people’s rights…anyway…I am NOT a BAR attorney, but an educated constitutionalist who is dedicated to exposing corporate greed, especially governments corporate greed…

Her X husband is now finally moving out of the foreclosing home (as she tried to get him to quick sale it long before foreclosure set in but he did not want to…) and is only making (with his college degree my daughter co-signed for) $400 a month as a pizza man… He has totally lost it!!!
My daughter is working as a social worker and does not make a lot of money in that field as she agreed to do that field for so many years as a way to help her pay her own student loan…Her HR told her they would have to honor garnishments if submitted…
But the important thing here is that she has legally changed her name back to her maiden name and her maiden name is NOT on the contract as a co-signer as well as the divorce Orders state she is not to pay for those loans…
My daughter has moved back with my wife and I, and she is an emotional wreck due to being a kind and compassionate person who always wants to help people…. And is now paying dearly for being kind to her X….

Regardless of the divorce decree, the lenders are within their rights to contact her for payment if her ex is not paying on time. She's liable for the debt.
It sucks. I know. I've been there. What she needs to do is take her ex to court.

Both she and her ex will end up being sued especially for the student loan...private loans do sue as a regular course of business. She would have to haul him back into court to make him pay either the loan off or her back...but the lender of the student loan will not get involved with the divorce decree.
It is too bad that lawyers are not upfront with their clients about these details.

Oh my goodness yes! Lawyers should be upfront and honest with their clients. On a regular basis I deal with the this, "but the divorce gave my husband this debt to pay". I have to explain to them that the DOE does not care what your divorce decree says and some refuse to believe us. They end up calling back after we start an administrative wage garnishment against them. By then, it is too late.
