We were in a debt management program in June 09 and left it in July 09 due to the company going to cost us more than needed and put us into a hole. So I emailed US Bank regarding the leaving of the debt management program at the end of July, they in turn emailed me back acknowledging that information - I have the email -. Now they are stating that we never told them and that they are threatening to come after our cars, house, and contact employments.

1st off what do we do about us informing them in July of our leaving the debt management program, and them not taking us off?

2nd, what about their threats to come after our cars, house and contact employment?

we are 90 days unpaid since last payment today 12/1/09.

thanks to anyone who has advice

See, even when you are not on the management program you still owe the debt. Hence, you must try settle the account now with US Bank. Have you tried negotiating them after dropping out of the management program?
Preserve the acknowledgment for future use.

If the creditor sues you and wins a judgment they might come after your assets or wage depending on the state laws.

IMO you must initiate a settlement process with them.

We are not trying to deny the debt, we are trying to deal with doing a settlement, however they are claiming we are still in the program and they are being a big pain, rude and not wanting to talk. My issue is that if they still think we are in the program then are they not going to settle, even though we have proof we left and informed them. I know they can sue against us, but that is the only way right? A formal lawsuit in court.
