a process server threw a summons for me at my husband after he refused service on my behalf and said you're served. i did not respond, now they have a court date for a motion for default judgment. what do i do

You can check the service process of your state to confirm if you were served properly or not. Depending on that you can get the judgement vacated on the ground of improper serving. But if you were served properly but didn't file the answer then it would be difficult to avoid the consequences of a default judgement.

To my knowledge, you cannot "refuse" service. If they ID you, they can drop it at your feet or toss it to you. You are served. Just did some googling and in some states, it is a misdemeanor to purposely evade being served. In some states they can serve you by mail or by publication.

You either gotta go to court or they get their judgment.
