I received the following query in my Twitter account:

We paid a settlement on a cc card in 2003, a collection agncy has a lien on our home for it now? We were just informed that the buyer of our short sale home, are paying the liens of 5000 total, title co. will send of payoff letter. It was in 2001 my husband paid setlmny but did not get letter, they sold balance to slimy attys, 07' atty got jugmnts 2 and liens on home.

It’s been mentioned that the lady paid "a settlement on a cc card in 2003" and it's also stated that "it was in 2001 my husband paid setlmny but did not get letter". So, I'm not sure if she is talking about 2 different credit card debts.

Well, though credit card debts are unsecured, the creditors can still put a lien on her property if they obtained a judgment against her. However, the creditors cannot force her to lose the house. The lien they placed on her home gets paid off only when she decides to sell the home.

It's a bit strange that she did not receive any letter or document as an acknowledgment for the settlement. Unless she has any kind of evidence, it'll be quite difficult for her to prove that she indeed settled the debt with the collection agency. Thus, there’s hardly any way to vacate the judgment against her and remove the lien from her property at this point in time.


Nah, it is not strange at all. It happens over and over again...if the debtor does not push to get a settlement offer in writing prior to payment, the CA will take their money and then sell off the rest of the account. Without it she is definately SOL and will have to pay the rest of the lien.
