Hello, I am in dire need of help, I received a letter from Pressler & Pressler saying I owe an outstanding hospital bill from years ago in the amount of I believe $1500.00 or more. After receiving this letter I contacted them the gentleman I spoke to was beyond rude to say the least. I attempted to explain to him that at the time I had insurance and obviously the hospital did not properly bill my insurance. However, at this particular time I am in a severe financial hardship. Because of the economy being what it is I am a server at a restaurant and this is our slow time of year and it is hitting me so very hard. So much so that I am behind in rent and I have a court date for the end of the month. How humiliating!!! I am a single mother of two children and this is taking a huge toll on me not only emotionally but physically. As I said Pressler & Pressler (CA) sent me ONE letter and wouldnt even discuss the matter with me, so five days later my employer tells me he received a letter to have my wages garnished and he can not continue to give me my pay. I work off tips but I do receive a weekly check between $60.00 to $80.00. This may not seem like much to most people but that money helps pay my rent and now because they sent this letter to my employer ( and they kept calling my job) I will not be getting my paycheck. My employer informed me that he hasn't sent them anything yet and wants to hold off as long as he can because he would prefer it continue to go to me. What upsets me is because of this very old emergency room bill from years ago, now I am losing up to $300 plus a month. I am a sane woman but I am at the point of not even wanting to live anymore because of this. If I lose my home and my children and I become homeless because of them taking my paycheck every week I don't know what I am going to do. I have no family and nowhere to turn. Why would they do this to a person? I just cant for the life of me comprehend this. Any advice or information that anyone may provide will be deeply appreciated. i DON'T KNOW HOW TO FIX THIS. My employer asked me to obtain a letter from whoever as to cover his back but I don't know how to go about any of this. I am so scarred and terrified and I am sick all the time from this. Hi colleen,

Can i know how old this debt is? When was the last payment made? These informations are needed to help you in your problem. Moreover they can't garnish your wages without winning a judgment. If they have won any judgment against you, you are supposed to know about that. According to Fair Debt Collections Practices Act, the creditor or collection agency is required to serve you a notice on the judgment. If they do not properly serve you, you have the right to vacate the judgment. For that you can visit the court, and fill out a form to file the motion to vacate the judgment.

colleen516, you have 30 days to dispute the debt after you receive a letter of collection. What you need to do is send them (certifed, return receipt requested) a debt validation letter requesting the information below; keep in mind that the FDCPA (Fair Debt Collection Practices Act) protects you, but you have to exercise your rights, so please make sure you do this within the 30 day window allowed by law.
The debt collector must send you supporting evidence of this alleged debt, and all communication and collection efforts must cease until they have sent you validation.
