US Bank charged off my account 9/09.Can they still sue me in order to collect?
Creditors can sue you!!!
Charging off a debt has no impact on whether the creditor can sue you or not. Generally, accounts are charged off by the credit companies/banks for tax purposes. In fact, in your case, the US Bank can sue you any time till your account crosses the Statute of Limitations expiry date prevalent in your state.
The SOL expiry date will vary from one state to another and depending on the type of the debt.

To me, charge off means lower settlement. cap One wouldn't settle with me but once it charged off and was assigned to a collection agency I settled the first day they called.
