whats are my rights in Virginia?

My debt originated w/ sears credit citibank. I defaulted and they decided to lower my credit line lower then my actual balance and charged me late fees, over the limit fees, etc. NCO had the acct. and now CFG has it. CFG wants me to make a down payment of over $600 and agree to $180/month for this $1800 outstanding debt. If I cannot afford this! I acknowledge that I do owe this and now that I finally have a job, i am willing to pay what I can. The rep stated to me that my offer is not good enough, they have declined letting me make my own pmts and send me a monthly statement. They are threatening a disposition, can they take me to court as they threatend, even though I am not refusing to pay? I just cannot pay the amount they want.

Yes they can take you to court if you are not pay per the card h
Yes they can take you to court if you are not pay per the card holder agreement. Since you are in default, your regular monthly minimum payment is a thing of the past.
