Payday Loan

I received a payday loan and had to close my bank account after faithfully renewing it due to my truck getting broken into. I setup payment arrangements with one person and right when I was two payments away from what he agreed to in writing (e-mail), another person in the same company e-mailed and said the deal is no good and I owed over 5 times what I agreed to just days before. What do I need to do?

What state do you live in? What is the name of the payday lender? How much did you originally borrow? How much have you paid so far?

TN. Emerald Marketing. $300. Settled for $125 and I was down to the last $85 making $45 payments

Emerald Marketing is not licensed to do business in your State. When you made the settlement of $125, did you get that in writing? Remember if a payday lender is not licensed to do business in your State, then you are only morally obligated to pay back the principal balance.

This is what he sent me in a e-mail response asking about my balance on 9/13/10:



Hey Joe,

I just spoke with you regarding this and made a $40 payment towards my payoff of $125. I am praying that I will be able to call back on 9/24/10 to pay off or down the remaining $85.00. Thank you for your time.

That is correct. $85.00 remaining. If you are not able to do the full $85.00 on your pay date $40.00 will be acceptable and we can extend the remaining balance out again. You???ve been a great customer and are always good on your word and for this I will be as flexible as needed. Thank you.

I would tell the other person that is saying the deal is not good, that I have it in writing from his company and this is the deal I am sticking to. Personally, I would stick to the original deal and then start pushing for a paid in full letter. Also, have you already filed a complaint with your State Attorney General's Office? If not, I would certainly do that.

Yes. I told them that I was going to offer to pay what the settlement was, and that is it. They never took my next payment out. I will just get a money order and mail it to them with the e-mails attached. Then I will push for the Paid In Full Letter. I will also do the complaint with the State Attorney General's Office regarding this! Thanks, I am going to guess that you hadn't had a chance to see if the other two companies I posted are licensed in the state of TN, so I will wait for your response to them.

Thank you so very much for everything! I am 63 days from becoming a single mother of two with my baby's father recently sent to prison and no government assistance, so being about to get these settled is going to be a blessing!

Paycheck today is not licensed. Therefore, you only owe what the principal balance. I could not find anything on Instant Cash USA. Call Tennessee Banking Dept. at 614-741-2236 and they should be able to tell you if they are licensed.
