Help with answer letter to summons
Date: Tue, 12/28/2010 - 06:50
A little back story- I received a civil court summons against a company (I will leave them nameless!)- which is a collection agency. I have not made any payments (currently looking into past bank records) since 2003 (which is over 7 years ago and past the SOL). They have that I made a payment in 2007 (which is false). I have tried contacting an attorney but have not talked to her in over a week and I am getting nervous (since the 20 day deadline is quickly approaching!). I talked to the Pronothary office (I know I messed that spelling up- sorry!) and they said I need to send in an answer have it dated and signed in blue ink. No mention that I need to send it to their lawyers- just them.
I composed a letter to send in- I just need to make it to the library to be printed (our printer is on the fritz). I wanted to run it past you guys to see if there was anything I should add or reword. I tried sending an email to skydvr, but I don't know if that went through.
Here it goes: (I will not put the case number and the collection agency)
I received a civil action summons for a consumer credit card collection.
I have never signed a contract, and or sent any payments with XX in regards to this disputed debt.
I am requesting to see proof of the evidence that there was a payment made on XX-XX-XXXX. For I have not made any payments of this disputed debt to XX or any other collection agency. The only payments sent towards disputed account was to the original creditor, XX.
On the evidence provided by XX, for the date of delinquency was dated XX-XX-2003. This is the last time that there was any activity on the disputed account. The month prior was the last time I had sent payment in regards to the disputed debt. Therefore, this lawsuit was filed outside the Statutes of Limitations.

looks okay.just get that to the court clerk as your answer asap.i think i know who you are,and who is the bottomfeeder.i will keep it mum,but state you get that to the court and don't even talk to the scum lawyers representing the bottomfeeder.once a court date is assigned you can talk to the lawyer you contacted then,or find another to counter-sue this piece of sh*t trying to sue on a time-barred debt.either way file that letter as your answer to the court asap.
