Hello,

If my checking account on Bank 1 is being hit for a $5000 garnishment, but there is only $1500 there, what happens to the remaining $3500 they are looking for?

Does it remain attached to Bank 1, waiting for funds to be deposited, or will they move it to Bank 2 and attempt to get it from there?


Bank accounts are not garnished, they are levied. Wages are garnished. Most likely, your funds have been frozen and they will continue to be frozen till the point you start paying them to satisfy the judgment they have obtained against you. Failing to do so will of course mean that once the account has enough money to satisfy the judgment, it will be taken out.
