I'm in the process of filing for Chapter 7 Bankruptcy due to financial hardships and got careless with payday loans. My only option at this point is filing for bankruptcy to get a fresh start. For those of you that filed for bankruptcy, once you pay the lawyer a retainer fee, what happens at this point?!? Does this make the creditors or pdl companies stop calling you once they find out that your filing bankruptcy?!? What is the "Automatic Stay"?!? I'm ready to do this, but just need some advice and clarifications on how this turns out. Thanks for reading.


Once you file bankruptcy, your bankruptcy attorney can inform your creditors including the payday loan companies about it and ask them to not call you any further. The court also orders an automatic stay against your creditors. It is a stay order which automatically stops lawsuits, foreclosures, garnishments, or any other collection activity against the debtor as soon as the bankruptcy petition is filed.

There is a difference between paying a retainer and actually filing the bankruptcy. Once a retainer is paid, your attorney will take all calls from your creditors. They call you, you refer them to him. However until the bankruptcy is filed, creditors can still pursue all legal remedies. Once you pay the bankruptcy fee and the case has been filed with the courts, then you have the automatic stay which stops all legal action.
