What about the harassing phone calls

I have fell victim to this "scam" and have done what you suggest. The ACH block, returned the money deposited, notified the BBB and my states attorney's office. However they are now calling me everday at my place of employment trying to convince me the loan was legit and I owe them another $590. Every action they say they are going to take I know are just tactics to get me to pay them the money they claim I still owe them. How do I make this stop? Is this grounds to file a harassment suit?


Yes sir, it is harassment!

You took steps to protect yourself from these scam artist (They should of backed down) but now you need to flash your weapons and maybe contact a lawyer. I suggest contacting lawyers a lot on here BUT not to be sue happy or make money BUT to stand up for yourself and bring these pricks down.

Start documenting or recording phone calls or phone conversations. Don't even tell them you will get a lawyer after them either. Let them stack up evidence against themselves, and when the time is right...your lawyer will do the paper work and someone will serve them papers to court :)

Hi,

Debt collectors use threats of violence and often imply that you'll be arrested if you don't repay the money on time. They even call your employer before 8. a.m and after 9 p.m. This is not in accordance with the FDCPA or the Fair Debt Collection Practices Act and thus you can file a complaint with the FTC.

If the debt that they're asking you to pay is really your debt, it is always better to take serious steps towards repaying it in order to put an end to all the harassing collection calls. Send a certified letter to the collection agency asking them to STOP calling you. If they still continue, you can sue the debt collector. You're entitled to actual damages, $1000 and they also have to pay for the attorney and court costs. You may also contact National Association of Consumer Advocates to get an attorney in your area.
