Hey all.

Sued by Cach LLC and Mandarich Law Group. In a county (San Francisco) other than where I live (Sacramento). Filed a Motion to Transfer Action and won that.

Now what?

1. Does the court automatically send letters to Plaintiff re: transferring? Or having won, do I still need to file some sort of form/order? (Why is it so HARD to get information from the Court system? Never mind, I know why.....)

2. If was served Discovery, and responded within the 35 days (that ended right before the Hearing), does that count if/when the case gets transferred? Is their Discovery and my response transferred, or timeline-wise, does the Plaintiff basically have to start all over again like filing a new case?

3. I had to pay my 'first filing fee' of $370 to start fighting the lawsuit. Do I get that back since was I sued in a county other than where I live and won the Motion to Transfer Action? Or is that just an expense I have to eat to defend myself?

Thanks

I think you can get the correct answer of your query from the county court clerk. I don't think you'll get back the fee mate. The plaintiff is likely to be notified about this. But I am not sure. I researched in the Internet and found this page. Check it out once.

Hope it helps you.

For the past two months since this started, if I wanted an answer from the clerk I've had to drive from sacrmento to San Francisco and show up in person.

No getting them on the phone, and no messages returned..... super annoying.

I'll try Sacramento's clerk's office. Don't know if can get them on the phone, but at least it's close to show up in person.

Thanks.
