i have been communicating with WWR in effort to avoid being sued and settling my cap one debt. They want me to agree to a consent judgement entry. Does anyone have any experience with this. Any information would be helpful.

Don't agree to the consent judgment entry. I think you should get help from a professional debt settlement company. They will negotiate with the collection agency to settle your debts. In the mean time contact an attorney. He can tell you how to deal with the situation. You can get information about WWR from the following pages:

Correct me if I am wrong, but wouldnt they have had to file a lawsuit already to get you to agree to a consent judgment?? A consent judgment will end litigation, but litigation would have already been started before you get to this point. DO NOT SIGN ANYTHING. DO NOT AGREE TO ANYTHING. Have you been served a summons yet? If not, you need to check with your court clerks office in your county and see if they have filed a suit already against you. If they have not filed in your county, then you need to ask WWR where they filed the lawsuit. A consent judgment is just a worthless piece of paper with no meaning unless it is agreed upon and entered into record by a judge in a court of law. If they filed a lawsuit against you and did not have you served, they broke the law. If they filed against you in a county where you do not live, they broke the law. And WWR is known for breaking laws.....please get back to me with more details before you make a move on this--they may be trying to illegally sucker you into a mess....

Thanks everyone. I should explain further. WWR told me on the phone a few weeks ago, when I was trying to make payment arraignments with them, that they were taking me to court and I would be receiving a letter stating this very soon. I then stopped the discussion about payments and waited for the letter to come, I received it last weekend, Friday, During the weekend they left messages for me to call them, I did call them Monday and they informed me that the actual suit had not been filed and wanted me to work on the payments again. This is when they informed me that if we would set up affordable payments they (WWR) would send me the consent judgement. I asked them what it was and they stated that it would be filled with the court and the suit would not proceed. I then stated that I would talk to an attorney and get back to them. The person on the phone said that no matter what they would get a judgement so I may as well sign the consent judgement. I am seeing an attorney tomorrow. I am trying to avoid BK but there is no way I will let them garnish my wages.

Just remember to check the court clerks office--they cannot simply file a consent judgment with the court unless there is a case pending in the court first. So, for them to say "we havent filed a lawsuit yet" and then say "here's a consent judgment, sign it and we will submit it to the court" makes no sense to me. The only way that they would need to submit anything, or even the only way they could submit anything like this to the court, is if they already filed the lawsuit in that court. I smell a rat...
