hi, back in June of this year i had some old credit card balances. one in particular was discover. orig. balance was 2600-2800.00 so i called up to
settle it for 1200.00. the rep asked if i could pay an additional 300.00
reluctantly i did. so when it was time for them to debit my checking account, they only debited my account for 1200.00 so i figured well i am not going to chase them down they will figure it out and debit the remaining 300.00 when time came around to do so there was not enought in the account because i had some other bills to pay. so we went back and forth on this now comes july and i get a bill in the mail for the full amount. (that's not going to happen) so i wrote to the chief executive officeer of discover to no avail. i have gotten 2 letters from them since
demanding the full amount. i then filed a complaint with the FTC as well as the BBB. to date, I have not heard not one word from anybody. no status nothing. last night when i came home from work, there was a message on my answering machine so i called and they came off saying that my account was going to get turned over for a judgement against me
and i stated the situation so now they are aguring the fact that i did not call them when the rest of the money was not taken out. i stated that was not my problem i am not going to do their job. so now here i am again having to make another payment plan which i did but now i am not sure if that was a thing or should i have waited to see what their next move would have been.


What the additional $300 was for? Was it towards some additional charges or it went towards the settlement amount? Haven't you received anything in writing from them after the settlement was done?

To get a judgement against you they need to sue you and win it. Have you received any summon yet? This could be a scare tactic by Zwicker to make you pay towards the account. I wouldn't have made any payment arrangement before being fully convinced about everything. Hope you have documented all your communication with Zwicker and can present before the court if needed.

no. i did not get anything in writing as to the agreement. it was all through the phone.

the additional 300.00 was part of the settlement. but when i first offered the 1200.00 she said she would settle for 1500. but they (discover) only debited my account for 1200. 00 and then demaned the 300.00 . which later i did not have. then i wrote to the CFO, and never heard a word of a response or anything. then i filed a complaint with the BBB AND FTC TO NO AVAIL. NOW I AM IN DEBT FOR 1800.00 WHICH I AM HAVING TO PAY THE ZWICKER AND ASSOCIETS. I MADE PAYMENT ARRANGEMENTS WITH THEM.believe i do not enjoy this at all but i felt like i was and still am back into a corner.

people you have to keep in mind that a settlement is a privilege not a right, so if the client doesnt want to settle the acct they dont have to. I think it was your responsiblity to call and find out why they didn't take the whole settlement amount.

that's ok i already made arrangements with them and the bal is going down so, i think i have about 10 more months and then i will be rid of them.

My advice to anyone...at all costs, stay away from Zwicker and associates. They are horrible, callous, vindictive people. They scare, threaten, intimidate and my fave one, do the good cop/bad cop (or rep in the instance). Do whatever you can to work something out with the creditor they are dealing with. Most of the time, they do not even owe your account. They want VERY badly to set up an account. I felt I was making a deal with the devil. Luckily I trusted my instincts and went with a debt relief plan. My creditor accepted my offer. Whew....what a lesson I learned. Never again.....

Debt Collection law firms are pretty vicious. You do have to keep in mind that in the legal profession even personal injury attorneys are looked upon with more esteem than debt collectors.

There's a running professional gag that if you can't find a job in BigLaw, in government (as a PD or ADA), a job in family law, or a job in personal injury, then you become a debt collector.

But the reality of the situation is that if you account is with Zwicker, unless your original creditor negotiates with you directly, you can and will be sued if you don't work with Zwicker.

yes, they can be real a**holes.. we have 3 accounts being paid thru them. 2 are low balances (under 2000), one is between 4000-5000 which is discover card. discover wants there money within a year, so 12 months is max getting it paid. we set up each one for 6 months, then review to either continue or settle. well, 2 are done with the 6 month pay, so will have to work with them again in october. not looking forward to that either, as we do not have the money to settle yet. one of them we might be able to work out over a 3 month payment. i have talked to a couple of people there other than my case worker (because they were not available), and they were really mean. but my caseworkers have been very nice & helpful.. i guess they know if you are mean, a consumer will too- and vice versa.

Since I have no job I told Zwicker today decease the calling because I have talked to an attorney they said they have to decease. So they said I have to send something in writing well they don't send anything in writing. So since there is no money I asked the guy at the attorney's office if I can send an email he said I could and then see if they don't stop then I can go after them.
The person I talked to was Mark @ 201-461-0059.
What the office told me is that they try and engage you in a conversation so they can get information just don't entertain this thought with them. Give them what you can allow or afford. Their's alot of people in debt because the Rich are not paying enough and have squeezed the middle out to the bottom of whatever they have had.
