I live in Florida and have never lived in another state and I rec'd a summons to appear in court for a credit card acct from 1997. I have a Court date in February that is going to be in the Judge's chambers with the atty representing the collection agency there by phone. This acct was charged off in July 2000 and my credit report lists the date of last activity on this acct as 11/1999. I have filed this information with the Court but it does not appear this atty is going to give up. It is my understanding that this is a time barred debt that he is attempting to sue on is this correct? any feedback would be helpful, Thanks!


I have to be in court Thursday for a credit card debt. It was written off in 2003, but someone bought it and they are now sueing me.I read somewhere that the suit has to take place where the company resides ,which is Deleware. I live in Florida. Where can I find the law that states this and how can I defend myself pro se?

I had a fender bender in April 03, I never recieved anything at all until september 07, to show up for a summons to appear for a pretrial conference to avoid a default judgement, which I went, and was very sick, going through disability, I never got a mediation, the judge said to me are you responsible for this accident which nobody recieved a ticket at all, I said absolutely not, judge said to the lawyer is there anything you wish to ask of this lady, he said no your honor, that was it, I told my story, I brought my insurance papers for my car at the time, thought I was covered which I should of been, and the lawyer said no your honor I have no further questions. That was that, everyone left, I got the summons stamped by a judge stating I have to pay it was a default judgement, now this happened inApril 03, they never reach me until September 07, the insurance company threatened me on the phone and letters stating the judge signed already I have to pay, the lady already got paid by her insurance company, there was no ticket, no injuries, nothing. I was threatened by the insurance company I would loose my license if I did not pay, so I was scared could not afford or in a matter of a month get a lawyer, that was that now I have been paying for 1 and a half years $60.oo a month, I am disabled I have already payed almost the amount of the judgement already, with the interest I can never pay this off, it started at 2301.00 now its 3.033.00, I cannot pay anymore this has to be dismissed, their is alot of discrepencies in all the paperwork, and they abused, took advantage of someone sick and documents are not right, wrong dates, wrong alot of things. Help

I was recently contacted by a collection agency trying to collect a debt from 1993. I don't have any documentation that I paid this off. I've written them a letter and they have forward dates of charged off and amount. I don't have any money to pay this debt. Do I have to?

I live in Florida and opened a credit card account with a former girlfriend back in December 2000. The $5,000 limit account was sold several times and was ultimately purchased by Cache, LLC in Jan 2010. The last payment recorded on their attached billing statement shows Dec 2006 (on an affidavit); however the Cache account information report has a last payment date of 10/20/2007. The final balance showing on account is $5,294.02 and the Cache account information report shows an additional interest of $2,777.39. I am being sued for $5,294.02 plus interest, costs and attorney fees. I cannot afford an attorney. I am the only person named as Defendant. I will be representing myself and I have 20 days to respond. I do not have the money to pay this debt, nor do I want a judgment against me. What defense can I plan for to avoid a judgment? Thank you.

What is the SOL in Florida for bank accounts that are closed that have unpaid service charges on them? I had a checking account with BOA and it was closed and now a collection agency is hounding me to pay $1,200 in overdraft fees and service charges. I wasn't sure what category this falls under.

:(i had got a vehicle from a buy here pay here lot in fl. paid on it for a couple of yrs traded it in on a van they talked me into using their insurance said it was cheaper wrote me a receipt and all, two weeks later call me and tell me i have no insurance send a tow truck and take the van because i refuse to pay again after showing the receipt they wrote me mind you this was in 2003, i have since moved to oh in 2006 have gotten a loan here for a motorcycle and two vehicles here just fine recently tried to get another loan and all the sudden i have this repossession against me of $10,000 for a van i had for 2 weeks and the price was my truck as a trade in and $5200 financed and this is just showing up on my credit in 2010 i am at a loss of what to do or even how to go about it and the carlot wont even answer my calls. Does anyone have a direction how long do they have to report to the credit, and do they have to notifiy me and where do i start please and ty at a loss
