Desperately in need of PDL advise in South Dakota
Date: Fri, 10/19/2007 - 23:47
When I first started reading all of the stories posted, I felt optimistic and hopeful that I too can get out of this mess, however, now I feel physically ill. I just read a post about South Dakota PDL laws, and it doesn't look good. It appears to me that SD is incredibly lenient, and I may be up a creek.
If anyone has any advise or wisdom to share, it would be GREATLY appreciated. Thank you in advance.
If it helps, I have loans with the following companies: Cash Transfer Centers, Cash Net USA, Cash Central, B.I.G., Cheiftan Financial, Apple Fast Cash, MTE, and one more that I don't even know the name of right now. I know, I am horrible.
Thanks again for any help/advise/opinions you can offer.

Good evening everyone. Just wanted to fill you in on my progress so far. I apologize if it gets too long.
I FINALLY got my checking account closed yesterday. I was waiting for a couple of checks to come through and they were hanging out there for what seemed like an eternity. I did have to pay a couple of stop payment fees, however, my banker was very understanding and assured me that closing my account was the best idea, and there would be no way for an ACH to "force" my account back open. I feel very relieved already.
I sent emails and faxes to most of the companies after revising the wonderful letter that VBM sent me. I had to make them specific to the SD laws that each company was breaking (because so many are "not specified" most were just in violation of one), and for a couple of them I didn't include the laws at all because those companies are legal and licensed in South Dakota.
I told my payroll department about the whole mess and asked that they reject any wage assignments that come their way.
Again, I am so happy that I found this site. I feel like I can breathe again! Thank you all for your help!
One other thing; in the letters I did leave the sentence stating that they are illegal in SD even if I didn't know it to be true. I figure if they are indeed legitimate - they can argue that fact with me and prove to me that they are! :)
Oh, also, I received the following email from one of the companies:
Hello (name removed for your safety. cannr),

Congratulations! Your loan payment of $435.60 was processed today and in six working days your account will be marked PAID and be available again. It must feel pretty good to know that you have worked hard and got yourself out of one of life's tough financial traps. If hard times roll around again, remember you have a friend at Star Advance. Thanks for trusting us in your time of need! Thank you, Team Star Advance |
Apparently they do not know that my account was closed and they will not receive the payment. I know it's not, but I was hopeful that this email could be interpreted as a PIF!! :)

darc, you are doing great! :D I'm cracking up over the email you got! Aren't they going to be surprised? LOL! I wonder what kind of email you'll get once they realize the debit was rejected? Oh my Lord! I guess they won't be saying they are your "friend" and thanks for "trusting" them! OMG!
Ha ha! I know, sickly I almost feel guilty. :) I was sorry
