Spouse debt

My spouse has some debt from a previous marriage and divorce. THe lions share of it has been taken care, only after my father loaned us a large amount of money in order to get out from under his car loan that they were trying to accrue up to 7% interest PER DAY.
My question now is that his credit is showing a report for $769 with Palisade, which was originally an AT*T cell phone debt. He actually did has this debt, but we have NEVER received anything regarding this debt. The only way we even know about it is through credit checks. When we call them for account detail we have basically gotten the run around an have not been able to get anything out of them. I am reluctant to send them the money for fear they will 'lose' it or try to get more out of us. What is the best way to handle this situation?

Hi,
First of all, I would like to know the date of last activity on this account. If this debt has taken place a long time back and payments have not been made in the recent times, the account might be past the SOL period. Under these circumstances, the company cannot force you to pay back the amount and can't take legal actions against you.
Send a letter to Palisades to validate the debt. Under the fdcpa laws, the company is required to send the itemized details of the account so that you can verify it. This debt validation letter will reveal important facts about your accounts including the SOL period in your state. Samples of debt validation letters are available in this forum. You can send it through certified mail with return receipt requested. If the statutes are over, do not make any payment otherwise the account might be brought back under the legal collection period. Keep everything documented in a file for records. You can also dispute with the credit bureau reporting this account if the collection agency is not willing to help.
