hardship case unable to pay someone trying to sue me

i had a car that i voluntarily gave back to bank because i could not afford it. now they are suing me and i have 3 children no spouse and do not recieve support from the father he is incarcerated .i can barley make it from pay day to pay day .can i file hardship case before the judge and if so how do i go about doing it


Your summons should have a section on it where you can file a Response to the court. You have 20 days to respond. Call the Court to verify.

If it's over 20 days, you must appear. Bring all the proof you have mentioned above: mainly latest pay stub, and W2 from last year. Also bring proof that you voluntarily surrendered the vehicle due to financial difficulties.

If you do not appear, the creditor will get a default judgment.
