Distressed Garnishment
Date: Wed, 01/06/2010 - 13:33
I currently have a default s.l that is under wage garnishment. I am trying to get it out of garnishment however AES/ PHEA will not work with me on payments at all... This being the reason I was forced to allow it to go into garnishment to start with.
I did a little research and today I wrote a letter of dispute to US Dept of Edu. However I'm not sure if my situation is considered hardship. (It definitely is for me.)
Tell me what you think.
I am a single mother of 1. I make about $960 of disposable income (with the garnishment), after all fully neccessary bills (daycare, phone, insurance, not incl. food) are paid I'm down to $385 per month. Garnishment is a full 15% = $85- 90 per bi-weekly paycheck. I am barely making it. Although $130.00 is a stretch I willing to pay it or the current garnished amount voluntarily, if it relieves this garnishment so I can consol. AES won't drop the garnishment so I can do so, unless I set up an automatic debit for $425 per month. Before the garnishment they were fixed on $390. These amounts are totally unreasonable. So I was forced to allow them to garnish my wages caused they wouldN't approve a lesser amount.
Does anyone no of any other way legally around the AES? or am I on the right track by writing the letter of dispute?

Unfortunatley, writing to the DOE for a AES/PHEAA account isnt going to get you very far.
