CA going to garnish my wages for federal student l

CA going to garnish my wages for federal student loans they are collecting on. Payments are 355.00 month can not afford to pay will not make any other arrangments other thatn this. I have made a few payments and today I paid 1/2 of what was due. They tried to refuse to take any payment at all until I insisted and then threatened garnishment. Can they do that? Where can I look for help?

CA can garnish your wages if they get a judgment against you from the court. The law also provides that they must send a written notice to you at your last known address 30-days before issuing a garnishment order to your employer. Apart from this, you'll also be given an opportunity for a hearing before the administrative law judge. You will also be given an opportunity to review your student loan records. Apart from this, you'll be given an opportunity to enter into a payment plan instead of the garnishment.

So, if I understand you correctly, the CA, on behalf of the [FONT=ARIAL, HELVETICA][SIZE=2]Guarantee Agencies, can go for [/SIZE][/FONT]admin wage garnishment and they can garnish wages without court orders. Thanks for the clarification :-)

However, if you could please show us a reliable website, preferably a government website, where it is mentioned, then it will not only help me in updating my knowledge about student loans but will help the other members as well.

Well... thanks for the links that you've given in the sticky section. I went through the link that you've mentioned in the Administrative Wage Government Rules section. However, it is no where written in the link that the "CA administers the wage garnishment on behalf of the guaranty agency". However, it is written that ED goes for the process of admin wage garnishments. However, ED uses contractors to assist in the garnishment process. As far as I know, debt collectors are never referred to as contractors. Can you please let me know if debt collectors are referred to as contractors in case of student loans?
