I have been divorced for 3 years. Prior to our divorce I discovered my wife at the time had taken out 65,000 worth of student loans. I knew of one for 5000. Needless to say I was stunned. In our divorce decree, by consent, I agreed to the responsibility of a portion of the 5000 I knew of. She was to be held responsible for the balance. At least according to the decree. I contacted the Student loan company claiming to be the administrator of this loan. They only used me long enough to garnish my wages. I faxed them all of the divorce decree information. They did not care. They are taking 20% of every check. They said that they will not stop and do not have to. I was married to her when she took out the loans. Can this be stopped? Please help me. Thank You


I have no idea. The representative on the phone declared it was. At first he claimed they were my student loans. And after rebutle he said it was a consolidation loan between my wife and I. I requested copies of these [PHP][QUOTE][/QUOTE][/PHP]documents. No surprise they never showed up. He even claimed I signed them. No way. I am sure it is her/my x that signed for both of us. Either way, the next communication I received was the gaurnishment. I had asked him what the loans were for and he said student loans. I replied, " OK Einstien, don't you have to be in school to get a student loan?" I guess that angered him when he was making his case for the loans being mine. It never pays to be funny. It just feels good.

I would be remiss if I did not thank you for the probing questions. This leads me to believe it is possible. Just need to explore the details to the agreement. I need to petition this agreement. At the very least procure the organization administering the gaurnishment. I can not thank you enough for giviing me hope. I live in Arizona. The Divorce decree is in Arizona.
