My first PIF letter!!! YAY!!!!!!!!!!!

OMG!!!!!!!!!!!!!!!! I got my first PIF letter today! I sent out half of my C & D via email on Friday and the rest today. Well, Avantis financial was one of the companies that got their letter on Friday...well...I just checked my email and got the following email:

This letter is in response to the correspondence received on 7/20/09.

Directly responding to your concerns, Avantis Financial is confident that it has not violated any Florida statute or loan limitations. All loan applications, credit checks and loan approvals are conducted within the state of South Dakota, where Avantis Financial is a registered limited liability company and maintains a Money Lending License through the South Dakota Department of Commerce & Regulation. As you read on the documents you signed, there are clear and conspicuous disclosures made on both the Avantis Financial website, and also within the Note and Disclosure Agreement stating that all transactions are conducted in the state of South Dakota, and that South Dakota law applies to all matters therein. You agreed to these provisions in order to receive a new loan from us as well as the loans taken with us in the past.

Avantis Financial does not operate a store or business in the state of Florida, nor is any employee of Avantis physically present in the state of Florida. All transactions are conducted under the laws of the state of South Dakota as so stated in our contracts. Our contracts are drafted in the state of South Dakota, accepted in the state of South Dakota and are executed in the state of South Dakota. Under the general principals of conflicts of law, our contract and business is deemed to be conducted in the state of South Dakota.

In an effort to settle this amicably, we will bring your current account with us to a zero balance and will also permanently close your account with Avantis Financial.

We will now consider this matter resolved and no further action is necessary at this time.


YAYYYYYYYYYYYYY!!! One down...11 more to go. That's right...you heard correctly...11. I know it sounds like a lot, but the majority of my lenders, I have already overpaid and have had several loans in which I have overpaid. I put in my C & D letters that I didn't want a refund, just a zero balance and a PIF letter...so far, so good, right? Stayed tuned to this thread. I will give updates here.


Okay guys...I'm back...with my second PIF letter!!!!!!!!!!!!!!!!!!!!!!!!!! This time its from impact cash usa. This was kind of a funny one. I have had more than one loan with them in which were all paid (illegal fees and everything). Well, this current loan that I had was for $300.00, and I had paid them $625.00. So I sent out my C & D letter finally, because their website had been down and I called to get their updated email address (I will post this new email in a new thread). Anyway, this nice enough guy named Jason called me yesterday, once today and he emailed me. I re-emailed the letter stating that I was disputing the debt; but no sooner than I sent, that I received another email from the Accounts department saying the following:

"We are sorry to hear you have not been satisfied with your experience with RBT Loans. We have reviewed your account and we are willing to settle with what has been paid. Your account as been marked as settled. Please let us know if you have any questions.

RBT Loans"


Grinning from ear to ear...I forwarded the email back to Jason stating that his company has just sent me the following email and to please be advised. He wrote back saying that they basically sent that letter after that had him try to collect the debt from me...miscommunication!!!! Not my problem anymore...I'M FREE OF IMPACT CASH FOREVER!!!!!!!!!!!!!!!
