I beat MRC Receivables in court today thanks to this site!

Thanks so much for all the help!

After learning that MRC Receivables is a junk debt buyer, and after learning what "junk debt buyer" means I was very irriated.

If not for this site I might well have wound up having a judgement against me. I was so nervous in court - I spent hours preparing my defense - I thought they were going to show up with documents to proove I owed on the debt....but at court it was MRC's lawyer who told the judge to dismiss the case with prejudice.

WHEH! Just wanted to share.

Let me elaborate - I followed advice from this site & this was my 3rd court date.

When I filed my answer @ 1st court date I demanded debt validation & that the case be dismissed with prejudice if validation was not provided. Honestly - I don't even know what "with prejudice" means - I was just following some advice on filing my answer properly. Anywho - judge continued case @ lawyer's request.

At 2nd court date lawyer still didn't have debt validation - so judge moved to bench trail.

At 3rd court date (bench trail) I was so very nervous - I imagined they'd dig up old docs & doctor them up to look more recent to win their case, but they didn't. I think they didn't have their proof & knew they would not win, so rather than waste everyone's time they just told the judge to dismiss with prejudice, as I had requested in my filed answer.

On another note, I think the judge was surprised I filed an answer at all. The guy before me did not & judge was harsh w/him - telling him to come back to next court date & "come back with money".

I just wanted to share because I see so many other posting here are dealing with junk debt buyers - hopefully my story will help give some hope to those who might be feeling hopeless.

Good luck Carmel.
Perhaps you could tell me a bit about this debt, such as:

1. What kind of debt is it?
2. When was the first date of delinquency?
3. What state do you live in?
4. What collection agency are you dealing with?
5. What attorney are you dealing with?

Hi I work in a Law office as a legal assistant and just wanted to inform you that when your case is dismissed WITH prejudice it simply means that they CANNOT bring the case up at a later date. If it is dismissed WITHOUT prejudice it means at a later date if for ex. the company found proof of the validity of your debt they could reopen that case. So basically you want the case to be dismissed WITH prejudice.

Hello,

On Saturday February 28th 2009 My roommate was approached by A man asking for me. My roommate told him I was not at home. The man asked my roommate for his name which he gave to him. The then offered a latter to my roommate a asking him to give to me. When my roommate told he would not accept the document the mane simply set the document on my roommates vehicle and walked away. I came home that evening to my surprise the man had left a summons for stating MRC Receivables vs Me! As I reed the document it stated that I am summoned to appear within 20days after the service up the above entitled action. I don't know what this is about nor what does this mean! Can some please Help!!

I recieved a settlement request from listing Mhc Recievables as the store name but it does not show who the debt is owed to. As far as I know, I do not owe this debt. Should I respond? I have heard of lots of people being sent notices that send money for something that does not exist

if they provide an address guest send a DV and C&D letters to it.send them certified mail return receipt.

MRC has done the same thing to me - sent me a warrant notice of a court date with 5 days to prepare. No details of who the creditor is? First thing I'd like to do is reschedule the court date - in an effort to get prepared and research how to handle, in addition I have a hard, non-cancellable work trip I cannot miss. How do I go about rescheduling? I am in Massachusetts.

I have a quick question....
I received a summons today. I'm being sued by a junk debt attorney for 2090.00 for which my Credit Card was only 1500.00. I am currently unemployed and have nothing to my name. I live with my inlaws and I'm not sure what to do?? Any help would be great.
