I got a PAID IN FULL letter!

So, not the best outcome. I would ideally have liked a refund of the interest paid. Because they are wrong and Oregon law states that even though the contract is signed online Oregon law applies.



Here is the letter I received from the PDL:

Dear **************:



I am writing on behalf of Payday Services in response to your recent email. Payday Services strives to assist consumers with their short term cash needs and is concerned that you were disappointed with your experience. We have noted your revocation of your ACH authorization and your request for no future communication by telephone.



Regarding your concern that the loan made to you was illegal in Oregon, please note that your loan was made pursuant to Payday Services’ license in its home state of Utah under Title 70C of the Utah Consumer Credit Code. Payday Services’ contracts, including the loan agreement you signed, clearly designate Utah law as governing its transactions and provide all disclosures required by Utah and federal law. Payday Services has no physical presence in the State of Oregon, and does not solicit Oregon consumers via mail, telephone, or email. In order to obtain a loan from Payday Services, an Oregon consumer must log on to the internet and access Payday Services’ website, just as you did. You received documents in conjunction with your loan fully describing how the finance fees are applied and your repayment options, and you agreed to these terms, including the applicability of Utah (not Oregon) law to the transaction, with electronic signatures in multiple places. Should you require another copy of your documents, please contact us. A careful review of those documents should resolve your concerns regarding the repayment terms applicable to your loan.

Notwithstanding the foregoing, we do understand that the current economic situation has adversely affected many people. Pursuant to your request, we have agreed to settle the balance owed and have marked your account “paid in full” as of today’s date. Payday Services is taking this action without legal obligation to do so because of our ongoing commitment to customer satisfaction and for no other reason.
