Another PDL bites the dust!

Received this yesterday via e-mail from one of my pdls:

I am writing on behalf of *******in response to your recent email. *******strives to assist consumers with their short term cash needs and is concerned that you were disappointed with your experience. We have noted your request for no further contact by telephone as well as your revocation of ACH authorization.

Please be advised, however, that ******does not conduct business in New Jersey, has no physical presence in New Jersey, and does not solicit New Jersey consumers. Therefore, it is not subject to New Jersey’s jurisdiction. Your loan was made pursuant to Web Payday’s license in its home state of Utah under Title 70C of the Utah Consumer Credit Code. You received documents and disclosures in compliance with federal and Utah state law in conjunction with your loan fully describing how the finance fees are applied and your repayment options, as well as the frequency with which they are applied. Contained therein is a description of how the fees and principal were applied to your loan, as well as the loan renewal process. You agreed to these terms, including the applicability of Utah (not New Jersey) law to the transaction, with electronic signatures in multiple places, and you also committed to binding arbitration to resolve any disputes arising out of the loan transaction. These documents were emailed to you at the time your loan was processed. Should you need additional copies, please visit our website. All information regarding the nature of the debt and applicable finance fees is enclosed therein. A review of these terms should address all of your concerns regarding repayment of your loan and the applicable process.

Notwithstanding the foregoing, we do understand that the current economic situation has adversely affected many people. Pursuant to your request, we have agreed to settle the balance owed and mark your account “paid in full” as of today’s date. *******is taking this action without legal obligation to do so because of our ongoing commitment to customer satisfaction and for no other reason, and we hope this will bring an amicable resolution to your inquiry.
Thank you for the opportunity to clarify this matter and address your concerns.

Now, I overpaid them $250. Should I just accept this PIF or insist that they send me refund, or just "let sleeping dogs lay"?


according to the dept of finances in utah, this company is not licensed in utah and hasn't been since january of 2008.

in my case, i was happy with PIF's because that to me might have started another war with them. i was happy to get no more phone calls, home or work. congratulations to you :)

I'll try an e-mail requesting the refund and see what happens. Nothing ventured, nothing gained. If I don't hear anything, I'll let it drop and be thankful for the PIF.

Thanks guys. You have no idea how relieved I feel now that I've got my finances back under control.
