WEBPAYDAY!!!!!!!!! YEAH 2 down 4or5 to go!!! This is what I sent them:

This is a cease and desist letter and revocation of any rights illegally given to you:
Per information rec'd from the NC attorney General's office you are operating illegally in NC. You have no license to operate here. I am withdrawing any garnishments or wage assignments that I may have signed. You have no authorization or rights to pursue in monies in NC. I am filing a complaint with the BBB as you are not a member and are not in good standing. Please cease and desist in contacting me by telephone. You may correspond by email. If you correspond by email please send your license information to operate in NC.

This is what they sent me:

We are in receipt of your complaint dated August 6, 2007 and believe that
the facts are somewhat different than those in your e-mail.

I would however, like to share with you the terms of your loan. You received
documents in compliance with Utah state law at the time of your loan fully
describing how the finance fees are applied and your three (3) repayment
options (these are all available for your review should you require them).
Contained therein is a description of how the fees and principal are applied
to your loan, as well as the loan renewal process. You agreed to the terms
of this agreement via electronic signatures. In addition, you received the
following forms (we have all of these within our files):

. Form 1 - Completed Application with your ESignature
. Form 2 - Loan Note and Disclosure with your ESignature detailing an
itemization of your Annual Percentage Rate (apr), finance charge, amount
financed, and Total of Payments.
. Form 2b - Loan Supplement with your ESignature indicating your
understanding of your new loan terms, your renewal terms, and default terms.
. Form 3 - ACH Authorization with your ESignature authorizing Web Payday to
credit your account with the loan proceeds as well as debit your account for
the repayment of the loans and/or fees to Web Payday.

On Monday, August 06, 2007, as US Operations Manager for Web Payday, I was
made aware of this issue through a letter received and it is our desire to
resolve this matter with you.

Settlement Offer:

Even though your contracts clearly show that you agreed to the terms of your
loan, it is our strong desire to resolve this issue with you and, as such,
are willing to settle the account in full. Your loan is now marked as paid
in full and no further obligation is pending.

I appreciate your willingness to resolve this issue and regret its
occurrence.

Congratulations to you. :D I do believe that Web Pay Day knows they are in the wrong. They gave me a refund for my total overpayment when I sent them a letter. I didn't even have to get any agencies involved. They were quick! So, hopefully other who are dealing with Web Pay Day will see this and know that they can be dealt with fairly easily.

Web Pay Day is not licensed/legal. And they know this. They are one of the "better" pdl's regarding settling once complaints have been filed. You don't have to be in NC for this to happen. I'm in KY. Other members who've dealt with Web Pay Day are in other states. Web Pay Day is illegal. They know it. They get contacted by the BBB or whoever and they quickly resolve the matter. I wish other pdl's would act upon a BBB complaint like Web Pay Day does.
