taking collection agencies to court? Is it viable

I want to take some of the collection agencies to court for their inhuman way of transaction. Is it viable?

Welcome to the forums.

collection agencies are required to function within the rules laid down in the Fair Debt Collection Practices Act.

If the debt collectors assigned to collect the debt from you are breaking the fdcpa laws then you can file your case through Section 809 of the Consumer Protection afforded by the FDCPA.

You can look for an attorney who specializes in the lawsuits of FDCPA and FCRA violations.

Hi. Along with what Roxette said, I would recommend doing some research on the companies. Not only do you need documented complaints with the BBB and FTC, but I would also attempt to have some written or verbal conversations documented (recorded) where they violated your rights. This will go a lot easier if you have this, as a judge will only look at you as a debtor in court without it.
