Ok folks, here we go...
I go the results of my FOIA (freedom of Information Act) request from the Federal trade commission. I originally requested any information on consumer complaints or a federal investigation into Superior Asset Management between 1999 and September 15, 2005. The FTC gives you the first 100 pages free, and then they have a fee per page after that. They called me and the original request would have been $120.XX, cutting it down to 2003-2005 Reduced it to $90.xx and reducing it to 2004-2005 brought it to $73.XX. Needless to say I settled for the one year option.

What I received today was a CD containing 675 pages of complaints and related information on Superior Asset Management.

So far (after 31 pages)
4 Different addresses from what has previously been posted here (complaints filed since Sept 1, 2005, including a physical address in Ft. Walton Beach, FL)

5 Different Phone numbers:

They appear to work for:
Cingular
Verizon
T-Mobile
MBNA
American Express
Bell South
Alltel

Violations include:
Failure to provide written notification
Failure to validate
Character deformation
Furnishing inaccurate Information
Calling repeatedly
Calling repeatedly with intent to harass
Calling non debtor repeatedly
Collecting after payment /settlement received
Use of obscene, abusive, offensive language
Calls debtor at work when they know debtor is not allowed to receive such calls
Fails to investigate disputed information
Uses or Threatens to use violence
Collects unauthorized interest, fees, expenses.
Failure to identify self as debt collector.

AS I Digest more information I will post it here.

Based soley on the information obtained so far I intend to file a complaint with the Illinois Attorney General.

In reading these complaints it have also uncovered several other interesting patterns as well:

TMOBILE: Seems to havea large number of complaints associated with SAM becasue the consumers NEVER had a t-mobile account, or cancelled their accounts withing the 15 day trial period.

AT&T Wireless/Cingular : refers numerous accounts to SAM even after they have been paid. allegidly "in error". SAM then refuses to accept their clients "word" the accounts are actually paid, and continues to attempt to collect.


According to the BBB sources, they are not listed with them and have not responded to the mail sent to them. It came as undeliverable. They are assuming that SAM is out of business and if the consumers are having unresolved disputes, they need to take legal assistance.

Clay, I can not thank you enough for getting that information. I have had it. I think a civil lawsuit is the only way to get them to clean up their act. I found out that Fl. is already investigang them. See this link.

I also found the information about the Florida AG investigating them.

Currently I am in the process of due diligence with SAM (Validation, cease and desistCMRRR, etc) once that runs it's course I plan on filing a complaint with the Illinois AG ( and also advising that the FL AG is also investigating). I will forward a copy of my complaint to the Florida AG and well as the ACA and FTC and BBB in Chicago and Ft. Walton Beach, FL.

I am currently asking for $7000 relief from SAM (the max allowable under various federal laws). If they cannot validate, and continue to all the figure will undobtedly increase. Based on the FOIA information they will not cease their attempts to collect and they most likely will continue to violate the FCRA.

There also seems to be a problem with Experian refusing to remove reports made by SAM even though the consumer was able to provide doucumentation as to why the report made by SAM was inaccurate or otherwise needed to be legally deleted.

FOIA is a great way to arm yourself with useful information, however it definatly can be expensive if the company in question has a lengthy history of violating laws and hence a long paper trail.

My only question is why hasn't the FTC taken action against them yet??

How long did it take to receive all of the records you requested? I am going to flood the FTC and whoever else I can to have them take notice on this. I keep thinking about all the people who do not research their credit and who may not even realize that there are laws to protect them.

Wow, found this by accident. These folks are relentless and have reported false information to all three credit agencies. Is there anything I can do?
Why do the credit agencies accept information from this company?

They are reporting something on my credit and I have no idea how to get it off. The credit agencey says they validatedit?

Hi

Inaccurate information should be disputed and thereby removed from your credit file. If the agency has not validated the debt and is reporting to the bureaus, it is a violation of consumer protection afforded by the fdcpa. Consult your attorney and file FDCPA Section 809 ( b ) to get it removed from your report.

Also, the credit bureaus are not allowed to keep incorrect information in your file. You need to dispute it highlighting the item and request for verification. They will investigate with your information providers and if your dispute is found to be correct, your file will be updated and you will be sent a free copy of your report.

If you provide a proof with your dispute to the credit bureau and still incorrect information is appearing on your file, it is causing defamation and willful injury. FCRA Section 623 will recover the extent of damages incurred by the wronged party, as deemed by the courts.
