IN MY DIVORCE ( HE IS DISABLED) MY HUSBAND AND I NOTERIZED A LETTER THAT I WOULD NOT BE RESPONSIBLE FOR HIS BUSINESS TAXES. I KNOW THAT IS NOT GOOD ENOUGH SO I WANT TO MAKE SURE I GET THE $40,000.00 THAT IS DUE ME FROM THE SALE OF OUR HOME. WHAT DO I NEED TO DO TO GET IT, I AM MOVING 400 MILES AWAY. THE JUDGE SAID I GET THE 40 BUT THE IRS SAID I AM S'POSE TO PAY THE TAXES. CAN I PUT A LIEN ON THE HOUS AND NOTIFY THE IRS OF THE SALE SO THEY GET THEIRS?


If your husband business taxes were filed under his SSN and you were married at the time of the taxes being due then no matter what you do you both are responsible for the taxes. The court can require that your husband pays them but the IRS just wants and will take the money from the home sale. The outstanding mortgage(s) will be paid and then the IRS, then any other debts. If you have enough to pay the taxes and get your $40,000 I would get the court to issue an order to the escrow company to pay you before your ex.
