I have 9 payday loans and am now overdrawn.. I have no idea what to do. I'm in TN


j, first of all, do you have all the addresses that you need? If you need any, post which ones you need. If you have them all, that's wonderful. Your bank account is the first priority here. You NEED to get something done. I see you've been talking with goudah. She is good. She's good regarding banks. You need to get the bank to do something to stop the pdl debits. They will kill you. We can work on the letters. We can work on the complaints. I need you to post to tell me where you stand right now, regarding addresses, your bank, etc. We'll go through the whole procedure. Have you listed out all your loan amounts, what you borrowed (principle only), what you've paid? We need that.

j, anthony is good also. You're in good hands. Here is what you "owe" to these illegal companies. I did not factor in any illegal fees. Only the principle amount of what you had borrowed and the debits they took for the amount you have paid. Here is what I have come up with:
BIG borrowed 200/paid 155/owe 45
FASTCASH borrowed 350/paid 210/owe 140
WHITE SANDS borrowed 250/paid 225/owe 25
MIDLAND borrowed 300/paid 270/ owe 30
SGQ borrowed 300/paid 270/owe 30
LOAN SHOP borrowed 200/paid 120/owe 80
UNITED CASH borrowed 200/paid 180/owe 20
ONE CLICK borrowed 200/paid 180/owe 20
PAYDAYOK borrowed 200/paid 162.71/owe 37.29
I looked for Pay Day OK in Delaware and I'm not seeing a license. I could be wrong, but nothing came up for me. I also looked up White Sands in Utah. I had a pdl with them under "Instant Loan Today". They are not licensed. BIG you will not find anywhere. They are an illegal overseas pdl. United Cash and One Click Cash are MTE Financial and are not licensed. I do not believe Loan Shop is licensed anywhere. Fast Cash? Don't think so. Midland? Never heard of them, but doubt they're licensed. SGQ? I believe I've read they are illegal. So.......here is where we stand now.

Ok. So I go to the bank tomorrow. What do I do with the information you just gave me? I know that you said I will write them letters and file complaints, with help :). I am going to go through my account one more time and double check that I counted up all payments and didn't miss one, it's a freaking mess. So what next?

Anthony, you don't think you weren't on my mind as I was doing the math? LOL! I'm sitting here thinking "You owe nothing. You owe nothing. You owe nothing." LOL! :lol: Hell, all of these are illegal pdl's. Okay, j, here we go. Now that we know what you "owe" (you can always take anthony's advice.) you can have these amounts ready for your letters and complaints. I can't stress enough though that your first step is to get the account BLOCKED at the very least. Cry, beg, lie, whatever to get them to do what you want. Do not walk out that bank door without something being done to your account so that these debits do not come out any longer. Stress fraudulent charges, stress unauthorized debits, stress illegal companies. Hell, tell them you're working with an attorney regarding these pdl's. That's what I did. So I lied. Big crap. It put a little fire under their butts when I mentioned that. If you type in at the top in your web address (since I can no longer find the friggin link!) www.debtconsolidationcare.com/letter
It will come up with examples of letters you can use. You will just use them as an example. You need to put your individual information in regarding the pdl's, the state law, the amount borrowed, the amount paid, the illegal fees, etc. You need to be sure to revoke their debit authorization of your bank account, revoke any wage assignment you may have signed with them, tell them to only contact you via email or USPS, no telephone calls will be permitted, etc. Throw it all in one letter. Revoke everything! State your laws. Tell them they are not licensed/not legal. Tell them what you "owe" (which is going to be a hell of a lot less than what they want). And tell them you want a physical address to mail payments to since they can not debit your account any longer. They're going to have a fit. Let them. You need to file complaints. File complaints on every single one of them separately. And file one on MTE Financial themselves regarding the d/b/a's they use and illegal fees and not being licensed. File with the BBB (www.bbb.org), the FTC (www.ftc.gov), and your state attorney general. Just do a google search for your state attorney general. Look under consumer protection. They will have a complaint form. You may or may not be able to do it on line. The BBB and FTC you can do on line. Some states can file with their AG on line, but some can't. My state, I have to download the form, fill it out, and mail in two copies. I don't know what your state AG complaint procedure is. Have I rambled on enough now?

j, you're NOT an idiot! Please! We have all been there/done that! No question is stupid! You need to ask so that you'll know.
#1. Yes, we've actually been through all this hell.
#2. Your bank is an idiot. Tell them the debits are from ILLEGAL companies and they are UNAUTHORIZED debits. Good Lord. I'm starting to hate banks. And they DO have the "power" to reverse these debits off your account. They DO have the "power" to reverse any NSF fees off your account. They DO have the "power" to block/close your account. God, I hate them.
#3. You need the address for White Sands? Oh, honey, I have that, too. (Damn. I have way too much information!)

#4. You are writing to inform them that you are revoking their authorization to debit from your account any longer, you are revoking any wage assignment you may have signed with them, you are stating your state laws, you are telling them they are illegal/unlicensed to do business with residents in your state, you are telling them to contact you only via email or USPS - no telephone calls will be permitted, you are telling them that you have filed complaints regarding their company with the BBB, the FTC, and you state AG.
Did I cover it? Post again. Hell, I'm into it now!

And, I'm advertising for anthony again. LOL! :lol: You can click on his link to his web site. I keep telling people to take a look at it. It's good. He's got letters on there as examples. anthony is good. Straight forward, no frills, to the point, by the law. However, if you like, I can pm you one of my letters I sent to a pdl. I just did one letter, saved it, then just re-did it for each pdl to fit each individual one. Re-did the math, changed the pdl name, changed the dollar amounts, etc. Whatever. You can check out the letters on this site, check out anthony's site, or I can pm you one. Which you choose, just make sure you tailor it to fit YOUR individual needs - the pdl, the state law, the dollar amounts, etc.

Thanks. Sorry. I looked at the letters on both this site and Anthonys and didn't see anything exactly like what I was looking for. I did start the complaints with the BBB already. If you could send me a copy of your letter. I just want to get this right the first time. I feel like I'm drowning. I'm scared. But moreso, I am pissed at myself for getting into this *&%$!

Okay. Underneath my post is a little button with two people on it that says "pm". Click on that. A message will come right to me directly. It will not be posted on the forum. It's a private message. Do this now and just type "hey" or whatever to make sure you know what you're doing. I'll get the message. I'll reply to the message. When I do, look over to the side and you should see where you have 1 message (or whatever). It'll say you have a message. Click on that. The messages will come up. Click on the message and my response should show up and you can read it. Try it now to make sure it's working and we know what we're doing. I have the letter all ready to copy and paste in a pm for you.
